FIFA Final Party

TERMS AND CONDITIONS FOR PROMOTIONAL CAMPAIGN

1.      Only persons eighteen (18) years or older, on the date of the relevant draw, can claim prizes. Proof of age of the winner is required before redeeming a prize.

2.      Our employees and their immediate family members are not eligible for entry. For these purposes immediate family members are spouses, parents, siblings and children.

3.      Winners will be required to sign a Declaration of Compliance with these Terms and Conditions and a release form releasing each of our legal entities, their respective affiliates, parents, subsidiaries, directors, officers, employees, agents, dealers, dealer principles, distributors and advertising, promotion and public relations agencies (collectively, the "Releases"), from any and all claims or liability of any kind arising from or in connection with this contest or a prize, including, without limitation, claims or liability in connection with the acceptance, use or misuse of the prize as awarded. Declaration and Release documents must be completed and returned prior to collection of the prize or the prize may be forfeited.

4.      The Competition is open to Digicel Flex (Pre-paid) and Digicel Select (Post-paid) Subscribers.

5.      During the Competition Period Digicel Flex (Pre-paid) Subscribers are automatically entered when they subscribe to a Prepaid BlackBerry data plan. Digicel Select (Post-paid) Subscribers are automatically entered when they sign up for a Postpaid BlackBerry data plan. Digicel Prepaid and Postpaid Subscribers may also text “PARTY” to 9527 to enter. Each text entry costs $1.

6.      To be eligible to win, Subscribers’ accounts must be active and in good standing at the time of the prize draw. If calls to a subscriber number are barred, where service to a subscriber number has expired or has been deactivated or where a warning has been issued to a Subscriber in relation to service to his subscriber number the Subscriber will not be eligible to win.

7.      The Competition Period is from June 1, 2010, to June 30, 2010. Within 5 days of the end Competition Period, one (1) subscriber number will be selected per prize in a random drawing to be conducted by Digicel (or its designee) from among all eligible entries submitted during the period. The entrant will be contacted via the subscriber number selected.

8.      Prior to claiming the prize, the winner will be required to answer a knowledge testing question. If the winner cannot be contacted via his/her subscriber number on the Draw Date, or cannot answer the Competition Question, then another draw will take place. This process will be repeated until the prize is given away.

9.      After the draw, we will check if the winner complies with these terms. If the winner fails to comply with these terms the prize is forfeited and a new draw done.

10. We accept no responsibility for loss, damage, or claims cause by, related to, or in any way resulting from the prize, its exercise or acceptance. Winners agree that they will sign a Declaration of Compliance with these Terms and Conditions and a Release Form releasing each of our legal entities, their respective affiliates, parents, subsidiaries, directors, officers, employees, agents, dealers, dealer principles, distributors and advertising, promotion and public relations agencies (collectively, the "Releases"), from any and all claims or liability of any kind arising from or in connection with this contest or a prize, including, without limitation, claims or liability in connection with the acceptance, use or misuse of the prize as awarded. Declaration and Release documents must be completed and returned prior to collection of the prize or the prize may be forfeited.

11. Prize consists of a party for the winner and twenty-five (25) friends, who must all be eighteen (18) years or older as of July 11, 2010, to be held at Fairmont Hamilton Princess. The party includes food and beverages and broadcast coverage of the FIFA final. 

12. All costs and expenses not expressly included herein in connection with the prize will be the sole responsibility of the prize recipient.

13. The Winner must be able and available to attend the Final Party. The Winner assumes responsibility for inviting his/her twenty-five (25) friends.

14. Digicel is not responsible under any circumstances for, and hereby irrevocably are released and held harmless by all entrants from and against, any and all lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or transmissions or technical failure, jumbled, scrambled or misdirected transmissions, incorrect or inaccurate entry information, howsoever caused, or other errors of any kind, whether human, mechanical or electronic.

15.  Subscribers found to be tampering with or abusing any aspect of this Competition, as solely determined by Digicel or the judges, will be disqualified from any further participation in this Competition and will become ineligible to receive any prize hereunder. Any attempt by any person deliberately to undermine the legitimate operation of the Competition may be in violation of criminal and civil law, and should such an attempt be made, Digicel hereby specifically reserve the right (among other causes of action and remedies) to seek and obtain damages from and against any such person to the fullest extent permitted by law. Digicel’s failure to enforce any provision of these Official Rules shall not constitute a waiver of that provision (or of any other provision hereunder).

16. Digicel hereby specifically reserves the right to terminate, cancel, suspend and/or modify the Competition if any fraud, virus or other technical problem corrupts the administration, security, safety or proper play of the Competition, as determined by Digicel in its sole discretion. In such event, Digicel hereby specifically reserve the right (but not the obligation) to award some other prize hereunder (as determined by Digicel in its sole discretion) by means of a random drawing from among the eligible entries received up until the time of the impairment.

17. All the prizes are personal and cannot be transferred by winners.

18. A third party cannot claim a prize on behalf of a Winner even with a valid power of attorney.

19. The Prize is as stated and cannot be exchanged or refunded.

20. In the event of unforeseen circumstances Digicel reserves the right to offer an alternative prize without notice. No cash alternatives will be offered.

21. This promotion is subject to all applicable laws.

22. Winner will be required to participate in any planned publicity in connection with this competition and by entering the promotion, the prize winner consents to the use of his/her name, likeness, image, photograph for any and all programming and/or publicity promotion or advertising purposes, commercial or otherwise, in all media and formats used by us or our agencies, without further compensation, throughout the entire world in perpetuity.

23. These Terms and Conditions are subject to change.

24. Digicel’s decision is final and no correspondence will be entered into.

25. To claim the prize, the winner must present a valid and legal photographic identification and carry the phone with the wining subscriber number for verification that he/she is the person selected as the Winner.

26. We accept no responsibility for any prize forfeited in any way.

27. This promotion is subject to the laws of Bermuda.
