Description of Promotion:
· Buy One, Get One : Any new customer that purchases either a BlackBerry Storm 9500 or a BlackBerry Bold 9000 or BlackBerry Curve 8900 will receive a free BlackBerry Pearl Flip 8220 or a BlackBerry Pearl 8120 and a free Digicel backpack. Both devices require immediate activation.
· Nokia 1680 Prepaid: Any customers that purchase $50 of prepaid credit at the Digicel Church Street Store will be eligible to get the Nokia 1680 for only $10.
· Nokia 1680 Postpaid: Any new customer that opens a new postpaid account with a two (2) year contract on a minimum 300 minute plan will get a free Nokia 1680 and a free Digicel backpack.

Q. How does the Buy One, Get One offer work?
A. When a new customer purchases a BlackBerry Storm 9500, BlackBerry Bold 9000 or BlackBerry Curve 8900 the customer will qualify to receive one (1) free BlackBerry Pearl Flip 8220 or a BlackBerry Pearl 8120 and a free Digicel backpack. Both devices require immediate activation.
Q. Are prepaid customers able to take advantage of this Buy Get One offer?
A. No, the Buy One Get One offer applies to postpaid customers only with new activations.
Q. Are contracts required for the purchased BlackBerry and for the free BlackBerry?
A. Yes, both BlackBerrys require two (2) year voice and data contracts.
Q. Can I sign one BlackBerry up to Digicel and take the other BlackBerry away to sign up later?
A. No, both BlackBerry’s must be activated before leaving the Digicel Church Street Store.
Q. If I am an existing customer, can I take advantage of this offer?
A. Only if you open two new additional accounts (for the purchased and free BlackBerry) with new phone numbers. However, you may not close your existing account to avail this offer.
Q. If I buy two (2) of the paid phones do I get two (2) free phones?
A. No, the offer is limited to one free BlackBerry 8220 or BlackBerry 8120 per customer.

A. With your purchase of one BlackBerry with voice and data, you will receive the one free BlackBerry and one free Digicel backpack.
Q. If I activate a device other than the BlackBerrys or the Nokia 1680 on offer, do I receive the free Digicel backpack?
A. No, the backpacks are intended for customers that activate new postpaid accounts as set out in the End of Summer Sale offer.
Q. If I purchase another device that is not one of the BlackBerry or Nokia 1680 on offer, do I qualify for a free phone?
A. No, the free phone is only for customers that activate new postpaid accounts as set out in the End of Summer Sale offer.
Nokia 1680
Q. How do I qualify for the Nokia 1680 priced at $10?
A. To qualify you must purchase $50 of credit at the Digicel Church Street Store and then you will receive the phone for $10. Customers must put the $50 credit on their device before leaving the store.
Q. How do I qualify for the free Nokia 1680?
A. To qualify you must activate a 300 minimum plan or higher with a two (2) year contract.
Q. Can I close my existing account to take advantage of this offer?
A. This offer is intended for new customers with a new phone number or existing customer wishing to add an additional line. New customers will not be permitted to replace an existing account with a new account in order to avail of this offer.
The Digicel ‘End of Summer Sale’ Promotion
Terms and Conditions
1. Definitions
In these terms and conditions ‘Promotion’ means a temporary offer devised to promote usage of the cellular phone service offered by the Company.
2. Agreement
The ‘End of Summer Sale’ Promotion terms and conditions (“these terms and conditions”) shall govern the relationship between Digicel (
By purchasing one of the selected phones on sale, and activating a new postpaid (SELECT) plan with voice and data, you have agreed to these terms and conditions.
Customers upon signing up for a Postpaid (SELECT) plan are subject to the SELECT Plan Terms and Conditions.
‘The Promotion’ commences on August 19, 2009 and ends September 12th, 2009 or while stocks last (herein after referred to as ‘The Promotion Period’). Digicel reserves the right to terminate this promotion at any time.
We reserve the right to amend or unilaterally change ‘The Promotion’ and/or these terms and conditions subject to notifying you of such amendments or changes. Such notification may be by way of advertisement in the national media, SMS text messaging and/or our website. If your Digicel mobile phone is used by you after notice of any amendment or change, then you shall be deemed to have accepted same.
This agreement is governed by the Laws of Bermuda.
3. Promotion Description
Buy One Get One offer: When the new customer visits either the Church Street Digicel store or the
Nokia 1680 valued at $10 offer: When a prepaid customer visits the Church Street Digicel store and purchases $50 of credit they will be eligible to get the Nokia 1680 for only $10.
Free Nokia 1680 offer: When a customer activates a new postpaid account with a two (2) year contract with a minimum of 300 SELECT Voice (or higher) Plan they will be eligible to get a Free Nokia 1680 and a free Digicel backpack. Customer will not be able to change the plan until the contract ends.
Free Digicel backpack offer: When a customer activates a new postpaid account as set out in the End of Summer Special offer, they will be eligible to receive a Free Digicel backpack.
4. Fair Use Policy
‘The Promotion’ is offered for the personal use of individuals and not for commercial use. Any usage by an individual that in our sole discretion is intended for financial gain or profit by you will result in the immediate termination of ‘The Promotion’ offer to you.
5. Liability
1. The company will not be liable for any consequential loss or damage caused directly or indirectly by any defect or otherwise howsoever caused.
2. We have no liability to you (or anyone claiming through you) in contract, tort or otherwise for any loss or damage which is: (a) not our fault; (b) indirect and/or not reasonably foreseeable; (c) purely economic, special, punitive or consequential loss or damage (whether foreseeable or not) or any other form of economic loss, arising from our performance or non-performance of our obligations under this Contract including through negligence or breach of statutory duty to the extent permitted by law.
3. We have no liability to you (or any one claiming through you) if we are unable to carry out our duties or provide Service because of factors beyond our control including, but not limited to, the following:
(a) Acts of God; (b) outbreak of hostilities, civil riots, acts of terrorism; (c) act of any government or authority (including refusal or revocation of any license or consent); (d) power failures, failure of telecommunications lines, failure or breakdown of plant, machinery or equipment; (e) default or failures of suppliers, subcontractors or other telecommunications operators; (f) theft, malicious damage; (g) industrial action of any kind.
4. We have no liability to you (or anyone claiming through you) if we disconnect the phone or Suspend the Service.
5. If we are found to be liable to you (or anyone claiming through you) we limit our liability under this Contract up to a maximum of the amount charged for the valid entries made.
6. We, our associated or affiliated companies, their respective officers, agents, directors, principals, employees, attorneys, underwriters, successors and assigns will not be liable for or in respect of any effects, claims, actions, proceedings, suits and causes of action (whether at law or in equity and including emotional distress), liens, debts, damages, fatalities, losses or injury (whether property or personal, consequential or otherwise), judgments, liabilities, costs and expenses of every nature kind whatsoever, whether known or unknown, suspected or unsuspected,(altogether, “claims whatsoever”) arising out of or in respect to our equipment and/or any electronic or radio systems in equipment, vehicles or aircraft in your vicinity, or of any emissions or transmissions to, from, by or through our Network and/or equipment. If we offer goods and/or services as agents of any principal providers(s), we will accept neither responsibility nor liability to you for the performance, loss of profit, emotional or mental distress or disappointment, or provision thereof by such providers so long as we have identified the providers to you and identified ourselves as agents.
7. All conditions, warranties, terms and undertakings expressed or implied by statute, common law or otherwise (including but not limited to fitness for a particular purpose) are expressly excluded from this Contract to the extent permitted by law.
8. Each provision of this Clause operates separately. If any part is found by a Court to be unenforceable or inapplicable (in whole or in part) the other parts will continue to apply.
