When do both of these promotions start and end?
These two Anniversary promotions started on Friday, November 20th, 2009 and they will both end on Friday, December 11th, 2009 or until promotional stock lasts.

Anniversary Plan Promotion Extended to December 31st, 2009
What do I get with the Anniversary Plan?
You will receive 400 anytime local minutes, 400 local SMS messages and 4 MB data service.
Can I add additional services onto my account if I have this Anniversary Plan?
Yes you can. You may add the Unlimited Nights and Evening Package, the Unlimited Text Messaging Plan, the 100 International Text Messaging Plan, etc.
How much does the Anniversary Plan cost?
This plan costs $44 per month however please note that you will also have to pay a monthly Government licensing fee of $5.
If I am a new customer can I take advantage of the Anniversary Plan offer?
Yes.
If I am an existing customer can I take advantage of the Anniversary Plan offer?
You can take advantage of this plan only if you activate a new number under contract. You will not be allowed to close existing account in order to avail of this offer.
If I am an existing Digicel prepaid customer can I take advantage of the Anniversary Plan offer?
This offer is only for postpaid customers however if you are an existing prepaid customer and you sign up for a new postpaid account you do qualify for this offer.
With the Anniversary Plan will I have to sign a contract?
Yes, you will be required to commit to a one year contract.
What happens after the one year contract with the Anniversary Plan?
You will automatically be switched over to the 300 minute plan.
Before my one year contract ends can I switch to another plan?
Yes you can upgrade to a higher monthly voice and data plan however you cannot downgrade to a plan of less value.
What if I don’t want to be on the 300 minute plan after my one year Anniversary Plan contract is ends?
You will have to come into the store or email Customer Care (info.bermuda@digicelgroup.com) making a request of what plan you want to be on.
Do I have to pay an activation fee?
The activation fee ($20 value) will be waived at time of activation, however you are required to pay for your sim card ($25 one time cost) and the Government license fee ($5 each month).
Can I cancel my Anniversary Plan contract?

The contract ends and you are able to take advantage of any other promotion available to existing customers at that time.

· If you purchased a Samsung, Motorola, Nokia and Coral at the $4 or $40 sale price, you may cancel your contract; however, you will have to pay a $400 early termination fee.
· If you purchased a BlackBerry at the $40 sale price, you may cancel your contract; however, you will have to pay a $400 early termination fee.
· If you purchased a BlackBerry at the $244 sale price, you may cancel your contract; however, you will have to pay a $600 early termination fee.

We have no liability to you (or anyone claiming through you) in contract, tort or otherwise for any loss or damage which is: (a) not our fault; (b) indirect and/or not reasonably foreseeable; (c) purely economic, special, punitive or consequential loss or damage (whether foreseeable or not) or any other form of economic loss, arising from our performance or non-performance of our obligations under this Contract including through negligence or breach of statutory duty to the extent permitted by law.
3. We have no liability to you (or any one claiming through you) if we are unable to carry out our duties or provide Service because of factors beyond our control including, but not limited to, the following:
(a) Acts of God; (b) outbreak of hostilities, civil riots, acts of terrorism; (c) act of any government or authority (including refusal or revocation of any license or consent); (d) power failures, failure of telecommunications lines, failure or breakdown of plant, machinery or equipment; (e) default or failures of suppliers, subcontractors or other telecommunications operators; (f) theft, malicious damage; (g) industrial action of any kind.
4. We have no liability to you (or anyone claiming through you) if we disconnect the phone or Suspend the Service.
5. If we are found to be liable to you (or anyone claiming through you) we limit our liability under this Contract up to a maximum of the amount charged for the valid entries made.
6. We, our associated or affiliated companies, their respective officers, agents, directors, principals, employees, attorneys, underwriters, successors and assigns will not be liable for or in respect of any effects, claims, actions, proceedings, suits and causes of action (whether at law or in equity and including emotional distress), liens, debts, damages, fatalities, losses or injury (whether property or personal, consequential or otherwise), judgments, liabilities, costs and expenses of every nature kind whatsoever, whether known or unknown, suspected or unsuspected,(altogether, “claims whatsoever”) arising out of or in respect to our equipment and/or any electronic or radio systems in equipment, vehicles or aircraft in your vicinity, or of any emissions or transmissions to, from, by or through our Network and/or equipment. If we offer goods and/or services as agents of any principal providers(s), we will accept neither responsibility nor liability to you for the performance, loss of profit, emotional or mental distress or disappointment, or provision thereof by such providers so long as we have identified the providers to you and identified ourselves as agents.
7. All conditions, warranties, terms and undertakings expressed or implied by statute, common law or otherwise (including but not limited to fitness for a particular purpose) are expressly excluded from this Contract to the extent permitted by law.
8. Each provision of this Clause operates separately. If any part is found by a Court to be unenforceable or inapplicable (in whole or in part) the other parts will continue to apply.

A customer that purchases a BlackBerry at $40 or $244, the Anniversary Phone Sale price, must commit to a 2 year contract with voice (minimum 300 minute plan) and data plan (minimum 4MB plan).
